The United Nations Educational, Scientific and Cultural Organization recently declared transhumance pastoralism as an Intangible Cultural Heritage of Humanity. The notion of heritage seeks to recognize the culture behind the seasonal grazing movements along herding routes, between distant and dissimilar ecosystems. The pastoral families move with their herds from pasturelands used during the winter (winter-lands) to areas pastured during the summer (summer-lands). Whereas this is a key step towards the recognition of the cultural dimension associated to this ancient practice, a (...) relevant feature of transhumance pastoralism is its strong linkage with environmental dynamics. This activity developed in a spatiotemporal and co-evolutionary trajectory, which gave rise to a pastoral territory. A territory is the union or linkage of a meaning with a specific place, that is, the space that is appropriated and valued, both symbolically and instrumentally, by human groups. Hence, the pastoral territory represents the socio-ecological system that integrates a pastoral-based community with the natural environment that it inhabits. We propose a co-evolutionary approach to analyzing some key attributes of transhumant pastoralism, which modulate the socio-ecological interdependence. Based on a study case from Northwest Patagonia, Argentina, we identified and characterized seven attributes: (I) mobility, (II) connectivity, (III) temporal synchrony, (IV) local interdependence, (V) local ecological knowledge, (VI) adaptive capacity legacy, and (VII) mixture of land tenure. We discuss these features as examples that represent keystone socio-ecological attributes for the recognition of transhumant pastoral territories as a biocultural heritage. (shrink)

Given the breadth and depth of its medical, scientific, and corresponding social impacts, advanced biopreservation is poised to emerge as a disruptive technology with real benefits, but also ethical challenges and risks. This article addresses the issue of properly assenting children with psychotic disorders to participate in clinical research. Due to the protective concerns with such a vulnerable population, additional precautions are necessary to ensure that youth with psychotic disorders assent to research with an appropriate level of understanding regarding study procedures. Current literature suggests that positive/negative symptoms and minor cognitive deficits do not interfere with the ability to comprehend study-related information for adults with psychosis if the study information is presented through (...) an educative process. Similarly, youth benefit from repeated presentation of procedures and periodic assessment of their comprehension. An integrated educative process is proposed that emphasizes the importance of an interactive consent through repetition and participant/investigator feedback. (shrink)

This rich and varied collection of essays addresses some of the most fundamental human questions through the lenses of philosophy, literature, religion, politics, and theology. Peter Augustine Lawler and Dale McConkey have fashioned an interdisciplinary consideration of such perennial and enduring issues as the relationship between nature and history, nature and grace, reason and revelation, classical philosophy and Christianity, modernity and postmodernity, repentance and self-limitation, and philosophy and politics.

Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

This essay examines Foucault's stance towards the Enlightenment as formulated in three works he published in the last decade of his life. These works represent a partial modification of Foucault's attitude to the Enlightenment, rather than the dramatic shift claimed by some commentators. In order to substantiate this claim, the essay provides a reconstruction and critical assessment of three articles Foucault devoted to Kant and the Enlightenment, namely, ‘Qu'est-ce que la critique?’ , ‘Kant on Enlightenment and Revolution’ , and ‘What (...) is Enlightenment?’ . It argues that Foucault's reformulation of Enlightenment ideals in terms of an ethos of transgression and an aesthetic of self-fashioning is much closer to Nietzsche's vision of a transvaluation of values than to Kant's notion of maturity and responsibility. The pursuit of artificial consciousness requires conceptual clarity to navigate its theoretical and empirical challenges. This paper introduces a composite, multilevel, and multidimensional model of consciousness as a heuristic framework to guide research in this field. Consciousness is treated as a complex phenomenon, with distinct constituents and dimensions that can be operationalized for study and for evaluating their replication. We argue that this model provides a balanced approach to artificial consciousness research by avoiding binary thinking (e.g., conscious vs. non-conscious) and (...) offering a structured basis for testable hypotheses. To illustrate its utility, we focus on "awareness" as a case study, demonstrating how specific dimensions of consciousness can be pragmatically analyzed and targeted for potential artificial instantiation. By breaking down the conceptual intricacies of consciousness and aligning them with practical research goals, this paper lays the groundwork for a robust strategy to advance the scientific and technical understanding of artificial consciousness. Justifying involuntary psychiatric treatment on the basis of a judgment that a person lacks capacity is usually expressed in terms of a person’s ability to make a decision about his or her health and treatment. Typically, this relates to the ability to refuse treatment. Advanced biopreservation technologies using subzero approaches such as supercooling, partial freezing, and vitrification with reanimating techniques including nanoparticle infusion and laser rewarming are rapidly emerging as technologies with potential to radically disrupt biomedicine, research, aquaculture, and conservation. These technologies could pause biological time and facilitate large-scale banking of biomedical products including organs, tissues, and cell therapies.

It has become increasingly difficult for individuals to exercise meaningful control over the personal data they disclose to companies or to understand and track the ways in which that data is exchanged and used. These developments have led to an emerging consensus that existing privacy and data protection laws offer individuals insufficient protections against harms stemming from current data practices. However, an effective and ethically justified way forward remains elusive. To inform policy in this area, we propose the Ethical Data (...) Practices framework. The framework outlines six principles relevant to the collection and use of personal data—minimizing harm, fairly distributing benefits and burdens, respecting autonomy, transparency, accountability, and inclusion—and translates these principles into action-guiding practical imperatives for companies that process personal data. In addition to informing policy, the practical imperatives can be voluntarily adopted by companies to promote ethical data practices. (shrink)

We introduce a novel transdisciplinary conceptual framework that revolves around concepts of 'lenses' and 'tensions' to help navigate value diversity. First, we consider the notion of lenses: perspectives on value and valuation along diverse dimensions that describe what values focus on, how their sociality is envisioned, and what epistemic and (...) procedural assumptions are made. We characterise fourteen of such dimensions. This provides a foundation for exploration of seven areas of tension, between: (1) the values of individuals vs collectives; (2) values as discrete and held vs embedded and constructed; (3) value as static or changeable; (4) valuation as descriptive vs normative and transformative; (5) social vs relational values; (6) different rationalities and their relation to value integration; (7) degrees of acknowledgment of the role of power in navigating value conflicts. In doing so, we embrace the 'mess' of diversity, yet also provide a framework to organise this mess and support and encourage active transdisciplinary collaboration. At the beginning of 2020, COVID-19 became a global problem. Despite all the efforts to emphasize the relevance of preventive measures, not everyone adhered to them. Thus, learning more about the characteristics determining attitudinal and behavioral responses to the pandemic is crucial to improving future interventions. In this study, we applied machine learning on the multi-national data collected by the International Collaboration on the Social and Moral Psychology of COVID-19 (N = 51,404) to test the predictive efficacy of constructs from (...) social, moral, cognitive, and personality psychology, as well as socio-demographic factors, in the attitudinal and behavioral responses to the pandemic. The results point to several valuable insights. Internalized moral identity provided the most consistent predictive contribution—individuals perceiving moral traits as central to their self-concept reported higher adherence to preventive measures. Similar was found for morality as cooperation, symbolized moral identity, self-control, open-mindedness, collective narcissism, while the inverse relationship was evident for the endorsement of conspiracy theories. However, we also found a non-negligible variability in the explained variance and predictive contributions with respect to macro-level factors such as the pandemic stage or cultural region. Overall, the results underscore the importance of morality-related and contextual factors in understanding adherence to public health recommendations during the pandemic. (shrink)

This chapter draws upon the archaeological and philosophical literature to offer an analysis and diagnosis of the popular ‘ancient aliens’ theory. First, we argue that ancient aliens theory is a form of conspiracy theory. Second, we argue that it differs from other familiar conspiracy theories because it does distinctive ideological work. Third, we argue that ancient aliens theory is a form of non-contextualized inquiry that sacrifices the very thing that makes archaeological research successful, and does so for the sake of (...) popular accessibility. Rather than merely dismissing ancient aliens as ‘pseudoarchaeology’ on demarcationist grounds, we offer a more complicated account of how the theory works, and what ideological work it does. Ethics courses are most commonly evaluated using reaction measures. However, little is known about the specific types of reaction data being collected and how these reaction data relate to improvements in trainee performance. Using a sample of 381 ethics training sessions, major reaction data categories were identified. Content and course satisfaction were the most frequently collected types of reaction criteria. Furthermore, content relevance and course satisfaction showed strong, positive relationships with performance criteria, whereas content satisfaction demonstrated a moderate, negative relationship. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. On a pu croire ou espérer, un temps, que les monstruosités de la Seconde Guerre mondiale étaient derrière nous. Définitivement. Or partout, à nouveau, on massacre, on torture, on extermine. Comment comprendre cette facilité des hommes entrer dans le mal? La réponse à cette question devient chaque jour plus urgente. Michel Terestchenko rouvre ici le débat. D'abord, en complétant la démonstration de Hannah Arendt : de même que ce ne sont pas seulement des monstres qui basculent dans l'horreur mais (...) des hommes ordinaires, trop ordinaires, de même, montre-t-il, il n'est pas besoin d'être un saint pour accomplir le juste et secourir des victimes au risque de sa vie. Héros ou salaud? C'est toujours une petite décision initiale, à peine perceptible, qui décide du côté dans lequel, une fois engagé, on se retrouvera in fine. Mais qu'est-ce qui explique cette décision? C'est là où l'enquête de M. Terestchenko prend toute son ampleur. En procédant à une reconstitution critique du débat central de la philosophie morale depuis le XVIIe siècle, aujourd'hui relayé par la majorité des sociologues et des économistes, elle montre combien est stérile l'opposition entre tenants de la thèse de l'égoïsme psychologique et défenseurs de l'hypothèse d'un altruisme sacrificiel. Ce n'est pas par " intérêt " qu'on tue ou qu'on torture. Ni par pur altruisme qu'on se refuse à l'abjection. Les travaux qui analysent les phénomènes de soumission à l'autorité, de conformisme de groupe ou de passivité face à des situations de détresse, invitent à comprendre tout autrement les conduites de destructivité. Tirant les conclusions philosophiques de recherches récentes entreprises en psychologie sociale et s'appuyant sur certains exemples historiques particulièrement éclairants - tel le cas de Franz Stangl, le commandant de Treblinka, ou, à l'opposé, les actions héroïques du pasteur André Trocmé et de sa femme Magda au Chambon-sur-Lignon -, l'auteur propose de penser les conduites humaines face au mal selon un nouveau paradigme celui de l'absence ou de la présence à soi. En cherchant dans la pensée chrétienne des premiers siècles la matrice d’une conception nouvelle du pouvoir comme gouvernement des hommes — « économie » ou conduite des âmes —, Foucault aurait méconnu la signification proprement théologique, au sein du dispositif trinitaire, du mot oikonomia. Nous voudrions montrer, à partir d’une relecture du (...) 2e Discours (362) de Grégoire de Nazianze (329-390), dont Foucault tire le concept d’une « économie des âmes », que cette idée ne présuppose nullement la référence au schéma trinitaire et renvoie bien davantage au modèle du « patronage » romain, couplé à la figure sacerdotale du bon berger. Cette analyse conduira, en outre, à rappeler le lien de la « direction des âmes » avec le paradigme médical. (shrink)

L'ensemble couvre les vingt dernières années d'enseignement de M. Alexandre (1932-1952), dont le commentaire relève du genre "Auslegung" (qu'on pourrait traduire par "exposition") comme celui que firent de Kant (...) un Hegel ou un Heidegger, et qui se caractérise par une certaine manière de questionner les textes. Reprenant l'œuvre d'Aristote et la poursuivant, il a fait de la rhétorique et de l'argumentation la nouvelle matrice des sciences humaines après la mort du structuralisme. A l'occasion du centenaire de sa naissance, les auteurs réunis ici lui rendent hommage, mais aussi poursuivent, par leurs propres recherches, l'idée que la rhétorique comme l'argumentation sont (...) centrales. In this paper I show how Michèle Le Dœuff’s conception of philosophy as work is central to her articulation of a fresh conception of women’s role in philosophy and philosophy’s relation to other work. In Hipparchia’s Choice (1991, 168) she writes that ‘There is at least a third way of conceiving of philosophy and the history of philosophy: we can regard both as work, and thus as a dynamic, which can lead to and from each other.’ My objective is to (...) clarify this concept of philosophy as work and to show its significance and implications for understanding women’s relation to philosophy and the complexity of Le Dœuff’s thought concerning the nature of freedom and oppression. Dans son dernier livre théorique paru en 2003, Thinking in Education, Matthew Lipman indiquait qu’en philosophie pour les enfants, nous avons besoin d’une théorie des actes la pensée, car sans elle le travail, qui attend ceux et celles qui pratiquent cette discipline et qui ont à cœur de mettre l’accent sur la formation de la pensée en action, risque d’être sans effet appréciable. Pour faire un pas dans cette direction, il semblait clair à ses yeux qu’il serait approprié de tenir (...) compte, notamment, des recherches qui se sont intéressés aux locutions performatives. Car, ajoutait-il, le langage est, en un sens, une carte de l’esprit. Dans cet article, je souhaite faire un pas de plus, m’engager dans le chemin tracé par Lipman, mais en faisant appel cette fois à un linguiste, Gustave Guillaume – et la science linguistique dénommée psychomécanique du langage - qui a consacré l’essentiel de ses efforts, en tant que linguiste, à comprendre comment la pensée construit le langage en se construisant par le langage. Dans un premier temps, j’exposerai les principales articulations de la théorie de Guillaume concernant le langage, en me concentrant sur les distinctions qu’il y a lieu d’établir entre la langue et le discours. Ces deux réalités s’opposent à plus d’un égard. Ainsi, par exemple, alors que la langue est une chose qu'on emploie, le discours est le lieu de l'emploi que l'on fait de la langue. De plus, alors que la langue est le résultat d'une construction qui s'étale sur un espace de temps très long, le discours est un ouvrage dont le temps de construction est relativement très court. Qui plus est, au moment où le sujet parlant entre en activité de langage il a devant lui un discours à construire alors qu'il possède en lui une langue déjà construite. Dans un second temps, en m’appuyant sur les distinctions préalablement établies, j’examinerai comment ces différentes articulations prennent forme dans le jeu subtil des articles un et le en français, en montrant de quelle manière cette catégorie grammaticale représente une variation du concept qui n’est pas à confondre avec celle que les logiciens reconnaissent habituellement sous les termes de compréhension et extension du concept. Troisièmement, j’inviterai le lecteur à imaginer ce qu’il en aurait été du premier roman de Lipman – La découverte de Harry – si ce dernier avait connu la théorie linguistique de Gustave Guillaume concernant les articles. Cela aurait peut-être conduit Lipman à écrire une toute autre version de son roman philosophique. Imaginant ce que cela aurait pu donner pour quelques-uns des chapitres de ce roman, nous tenterons alors de nous mettre dans la peau du personnage principal – Harry – et de voir comment il aurait pu être conduit, aidé par ses pairs, à entrevoir que son entreprise de questionnement touchant la pensée propose, somme toute, un renversement complet dans le monde de l’éducation. Dans cet article, je tente de dégager les linéaments d’une politique messianique. Pour ce faire, je m’appuie sur la figure du chiffonnier tracée par Walter Benjamin, dont je parcours les différents traits. Il y va ici essentiellement d’un travail de sauvetage des lambeaux sacrifiés par le progrès dans sa marche nécessairement oublieuse et injuste. Un travail de sauvetage qui ne promeut aucune habileté triomphante, mais qui maintient la fragilité toujours menacée d’une exigence constamment à reprendre. Pour en interpréter la temporalité (...) spécifique, je me réfère aux travaux de Gérard Bensussan sur le messianisme. Il en résulte alors l’énoncé d’une politique faible, qui s’emploie à défaire les assurances du pouvoir, à limiter la toute-puissance de l’État, pour faire entendre les voix oubliées et soumettre la politique à une inspiration radicalement hétérogène. Michel Senellart partant de la lecture de Vattel (1714-1767) pose la question de l’« Étatisation de la guerre » et de la « qualification de l’ennemi », centrales pour réfléchir sur l’humanisation de la guerre fondée moins sur la définition du type de guerre que sur celle de ceux contre qui on se bat, ce qui permet le maintien d’un lien entre jus in bello et jus ad bellum. Les lectures divergentes de Vattel faites par Schmitt et par Bluntschli (...) conduisent à poser le problème de la place des États dans les lois de la guerre, le second défendant la création d’une législation supranationale, au nom d’une logique de paix et de respect du droit des gens, alors que le second considère une telle instance supra étatique comme un des facteurs de « barbarisation » de la guerre car elle criminalise l’ennemi et brouille la distinction traditionnelle entre « ennemi » et « brigand ». M. Senellart conclut son intervention en posant que la vraie distinction n’est peut-être pas celle qui différencie normativisme (Bluntschli) et décisionnisme (Schmitt) mais celle qui oppose conception républicaine (reconnaissant une légitimité au peuple en armes) et conception étatiste, d’où une distinction possible entre ennemi actif et ennemi passif. La mondialisation libère les uns et oppresse les autres. Et dans cette partition du monde, chacun est renvoyé à une identité prétendument essentielle et "vraie". D'où un véritable "piège identitaire", négation de l'autre et de sa subjectivité, parfois justifié par l'anthropologie - à l'opposé de sa vocation humaniste et critique. Face à ce défi, le regard contemporain sur le monde doit être repensé, en dépassant le relativisme culturel et ses "ontologies" identitaires. Dans ce livre, Michel Agier prend une position (...) résolument "décentrée", invitant le lecteur à reconsidérer les sens de la frontière : lieu de passage, instable et sans cesse négociée, elle nous fait humains en instituant la place et l'existence sociale de chacun tout en reconnaissant celles des autres. RÉSUMÉ Je veux m'attarder à trois aspects importants du Droit des gens de John Rawls. Je veux tout d'abord montrer que cette oeuvre contribue à réfuter l’interprétation erronée selon laquelle Rawls souscrirait à une conception individualiste du libéralisme. Je veux en deuxième lieu souligner l’importance d'intégrer un droit des peuples au sein de la philosophie politique libérale. Le principe de l’égalité entre les peuples peut être interprété comme ayant un corollaire, à savoir, le principe du développement égal des peuples, et (...) ce dernier principe est susceptible de nombreuses applications progressistes au niveau de la justice internationale. En troisième lieu, je veux suggérer que même si des amendements importants étaient apportés à la version initiale du Droit des gens, au point d'inclure, à l’encontre de l’opinion exprimée par Rawls, le principe de différence et d'en reconnaître l’universalité, on ne serait quand même pas en présence d'un libéralisme de type individualiste. ABSTRACT I would like to consider three important aspects of Rawls' Law of Peoples. I want to show, first, that the work serves to refute the mistaken interpretation according to which Rawls would subscribe to an individualistic interpretation of liberalism. Second, I also want to underline the importance of incorporating a law of peoples within a liberal political philosophy. The principle of equality between peoples can be interpreted as having a corollary, the principle of an equal development between peoples, and this last principle paves the way to many progressist applications at the level of international justice. Third, I want to suggest that even if amendments were made to the initial version of The Law of Peoples in such a way that, pace Rawls, it would now contain among its principles the difference principle and would recognize its universal status, the resulting approach would still not be a liberal individualism. The details of the patient case presented below have been modified to protect the family’s privacy. Despite these modifications, the author has made every effort to preserve the story’s clinical, social, and ethical nuances.The patient was born at 31 weeks with Trisomy 13 and lived her entire life (...) in the NICU. She was born to a 16-year-old mother (who I will call M.H.) as the result of an unintended pregnancy. This child was just about a month old when I became part of her care team. The patient was born with a severe congenital heart defect that our pediatric cardiac surgery team—as well as surgical teams at multiple other academic children’s hospitals—determined to be inoperable. Because of her severe heart defect, she required significant respiratory support throughout her life and continuous IV medications to keep her organs perfused.When I came on service, M.H. visited irregularly and depended on her mother (the patient’s grandmother, who I will call D.R.) for transportation. Social work had arranged for M.H. to have daily transportation to the hospital after school and work; however, M.H. was denied the opportunity to spend the night with her infant. It was against hospital policy for minors to stay overnight as visitors, and additional visitation guidelines related to COVID precautions were also in place at the time. As her biological mother, M.H. was designated as the patient’s healthcare decision-maker. The inability for M.H. to stay overnight on the basis of her age despite being the patient’s parent and healthcare decision-maker generated significant moral distress for several members of the care team. The social dynamic between M.H. and D.R. was such that D.R. was far more participatory in rounds and goals of care conversations, and M.H. was almost always reserved and withdrawn. On multiple occasions, different team members attempted to have conversations directly with M.H. She either was not engaged in the conversation, would answer with short phrases, or, when D.R. was present, would defer to D.R. to speak for her.Throughout the patient’s life, D.R. seemed to be the driving force behind most treatment and goals of care decisions. In multiple conversations I had with the family, both one-on-one with M.H. and jointly with M.H. and D.R., it was made clear that they wanted “everything done” and were hopeful for “a miracle.” D.R. emphasized that she didn’t want anyone to “give up” on the patient and wanted to exhaust all possible options for a cure. Overall, our team had become increasingly concerned that the medical decision makers for this patient did not comprehend the very poor prognosis of her congenital cardiac anomaly, either with or without surgery. As the medical team, we would be subjecting this child to harm that would be unlikely to change her prognosis. [End Page 19]Our NICU team, as well as various other teams, discussed the case repeatedly without a resolution that felt satisfactory. A complicating factor for this particularly socially and ethically challenging case was that the team turned over relatively frequently during the patient’s long-term stay, making it difficult for each successive team to understand what had already been done for this patient and her family. We decided to seek help from the Clinical Ethics Consulting (CEC) service. My expectation for the CEC service was that the consultant would help our team think differently about both the clinical and social elements of the situation and help us come to a resolution since we could not figure out a good solution on our own.Our consult question for the CEC was fourfold: 1) Did the patient’s mother meet criteria for an emancipated minor (to get around the visitation policy), 2) Is M.H. the appropriate healthcare decision maker given her lack of engagement in goals of care conversations and perceived understanding of the severity of her...
